Ohio: 26 Qualifying Conditions with an Ongoing Petition Process

Maryland: Physician-Driven Eligibility Across a Broad Range of Conditions
Maryland's medical cannabis program covers a wide range of conditions including cancer, chronic pain, seizure disorders including epilepsy, muscle spasms, MS, glaucoma, and PTSD, among others. Each qualifying condition was approved based on peer-reviewed clinical research, with the state's Medical Cannabis Commission citing published studies in its approval rationale. Maryland's program allows licensed healthcare providers significant discretion in evaluating patients, making it accessible for patients with documented chronic conditions who may not see their exact diagnosis listed.

Delaware: Open Eligibility Since July 2024
Delaware's approach is the most flexible of the four states. Delaware eliminated its fixed list of qualifying medical conditions on July 1, 2024, when House Bill 285 was signed into law. Healthcare providers now decide whether a patient's medical condition would benefit from medical cannabis use, meaning virtually any diagnosed condition can qualify with the right physician certification. Additionally, patients aged 65 and older in Delaware have the option to self-certify and do not need an MMJ certification from a doctor to apply for a medical marijuana card.
